Home > Citizen Services > Public Safety > Municipal by-laws application > RM 1982 RM 1982 - concerning snow removal operations Article 1- No owner, occupant or person in charge of a house or building shall allow the accumulation of snow or ice on the roof of such house or building or any part thereof so as to endanger people passing on the adjacent sidewalks or streets.
In removing said snow or ice, such owner, occupant or person in charge of a house or building shall take the necessary precautions to prevent any risk of accident to people passing on the adjacent street or sidewalk and shall immediately remove from the street or sidewalk any snow or ice falling thereon while it is being removed from the roof or other part of the building.
Article 2- It is prohibited to push or to deposit snow or ice in a street, on a sidewalk, in a municipal stream, in a municipal sewer system or on a property of the municipality.
The first paragraph does not apply to:
a) Snow or ice removed from a private property and which is pushed or deposited in that part or the street right of way which is adjacent to the same private property and which is bounded as follows (as shown in schedule A):
- The front line of this private property;
- The extension into the street right of way of the side lines of this private property;
- The sidewalk or, if there is no sidewalk, the street pavement;
b) Snow removal operations carried out by the municipality or by a person to whom a contract has been awarded by the municipality for this purpose.
Anyone contravening the present article is liable, in addition to the penalty decreed hereafter, to the payment of any expense incurred by the municipality to remove this snow or ice.
Article 3- The Director of Engineering and the Director of the Public Works Department, their assistants and any other persons designated by them for that purpose are authorized to:
a) Divert the traffic in the streets of the City for the performance there of works on roads, including the removal and clearing of snow, and for any other reason of necessity or emergency;
b) Remove and convey, or to cause to be removed and conveyed, any vehicle parked where it hinders the work of the City and to tow such vehicle elsewhere, either to a garage or to a service station, or to a piece of land or building belonging to the City; in such case, the towing will be done at the expense of the owner of the vehicle who may only recover possession thereof on paying the actual towing charges according to the bill received by the City which shall not exceed fifteen dollars ($15.00) and the storage cost which shall not exceed a rent based on the current rates of the garage concerned for the storage of automobiles;
c) Place temporary no parking signs in areas where parking would otherwise be permitted for the period of time required to carry out any type of road work, including the removal and clearing of snow: where a vehicle is parked while parking is thus temporarily prohibited, the provisions of the preceding paragraph apply.
Article 4- No owner, occupant or person in charge of a piece of land or lot situated at the intersection of streets, shall pile or tolerate snow to be piled thereon in such a manner as to obstruct the visibility of motorists approaching such intersection.
Article 5- The employees of the City in charge of the winter maintenance of roads and sidewalks are authorized to blow or pile the snow on sidewalks and private grounds; however, in so doing they must take precautions in order that:
a) Trees and shrubs on private grounds are not damaged;
b) The snow thus blown does not reach a building or a pedestrian.
Article 6- Anyone contravening a provision of this by-law is liable to a fine, not exceeding three hundred dollars ($300.00), with or without cost, as determined by the Court of competent jurisdiction. Said Court may order the imprisonment of the accused if the fine, with or without cost, is not paid immediately; however, such imprisonment shall not last for more than two (2) months and shall cease immediately upon payment of the fine or of the fine and cost as the case may be.
If the infraction continues, such continuation shall constitute a separate offence, day by day.
Article 7- The present by-law shall come into force according to law.
