RM 2642-concerning the granting of permits to peddlers
Article 1- In the present by-law, unless the context otherwise requires, the following expressions shall mean :

a) Sticker: Label bearing an indication that peddling is prohibited

b) Peddler: Whoever, by itself or any of its representatives, offers merchandises or services, solicits for money or goods from door to door

c) Director: The Director of the Public Security department of the City of Pointe-Claire and any of its deputies so designated by the City

d) City: The City of Pointe-Claire

Article 2- No one may operate as a peddler within the City's territory, without having first obtained a licence issued by the Director for that purpose.

Article 3- Any request to obtain such licence, according to the present by-law, must be presented on a form provided by the City, be signed by the petitioner and contain the following information:

a) Name, address and phone number of the person in favour of which the licence shall be issued, as well as that of the petitioner if they do differ;

b) The location or locations within the City's territory where the activities shall be carried out;

c) Days and hours during which the activities shall be carried out;

d) If the request is to renew a licence, the latest date the permit or its renewal was issued.

Renewal means the person requesting and obtaining, for a second time or more, a licence issued under this by-law.

Article 4- The request which is referred to at article 3, must be accompanied by the following documents:

a) If the person in favour of which the licence shall be issued is a moral person: a copy of the charter of the letters patent providing for the constitution of this moral person;

b) If the petitioner acts on behalf of a moral person: a true certified copy of the resolution authorizing him/her to submit a request;

c) where the person in favour of whom a licence shall be issued intends to hire agents or representatives: a list that includes names, addresses, and phone numbers of all of these agents or representatives;

d) If it applies, a true certified copy of any permit requested by virtue of the consumer Protection Act or of any applicable regulation enacted under this act;

e) A certified check or money-order, payable to the City, for the tariff indicated hereinafter established to cover the administrative costs incurred for the study of the request and the issuing of the licence;

f) If need be, a document (tax bill, driver's licence, etc.) establishing the domicile of the person, in favour of whom the licence shall be issued, in Pointe-Claire.

Article 5- The study of a request to obtain a peddler's licence and its subsequent issuance, are subjected to the prior payment of the tariff hereinafter established according to the category to which the person, in favour of which the issuance of the licence shall be requested:

a) Physical person domiciled in Pointe-Claire: 100$ (initial period) plus 5$/additional day

b) Physical person non-domiciled in Pointe-Claire: 250$ (initial period) plus 10$/additional day

c) Moral person without pecuniary gain, pursuing charitable, cultural, recreational, leisure or scientific activities and having its main office in Pointe-Claire: 0$

d) Any other moral person: 250$ (initial period) plus 10$/additional day

Article 6- After having studied the request and if it is complete and accompanied with all the necessary documents, the Director issues the peddler's licence in favour of which the request had been submitted.

Article 7- The issued licence, according to section 6, is valid for an initial period of 30 days and for the number of additional days mentioned thereto, that shall not be in excess of 30 additional days, from the date of its issuing.

Such a licence may not be renewed until a period of 9 months has gone by following its issue.

Article 8- The licence issued according to section 6, shall not be transferable.

Article 9- The holder of an issued licence according to section 6, shall be authorized to carry on its activities during the days for which this licence has been issued:

a) From 9:00 a.m. to 4:00 p.m. from Monday to Friday;

b) From 1:00 p.m. to 5:00 p.m. on Saturday and Sunday.

Article 10- The holder of an issued licence, according to section 6, and if that is the case, any of its agents or representatives shall:

a) Carry on their activities without in any way troubling the peace and tranquility of the citizens;

b) Carry a copy of the said licence and identity card with photography at all times;

c) Be under the obligation to show up the issued licence and its identity card to anybody who requests so.

Article 11- Any resident may display a sticker, indicating that he/she wishes that no peddler calls on to its residence, in a visible manner on the mail box or on the main door of the residence.

Article 12- It shall be prohibited for any peddler to knock on the door or to ring the doorbell of any residence displaying a sticker as provided for section 11.

Article 13- Whoever shall contravene any provision of the present by-law or suffer or permit any such contravention, shall be guilty of an infraction and liable to a fine, plus costs, of:

a) 500$, when the offender is a physical person

b) 2 000$, when the offender is a moral person

If such offence is repeated, the amount of the fine, plus costs, shall be of:

a) 2 000$, when the offender is a moral person

b) 4 000$, when the offender is a moral person

Article 14- Paragraph c) of article 2 of by-law 2396, regulating various trades and industries shall be repealed.

Article 15- The present by-law shall come into force according to law.
