The Borough Council decrees as follows:
1. Notwithstanding the provisions of the by-law number 2568 of the City of Pointe-Claire and its amendments, a dog run shall be made available for the keepers or owners of dogs in Terra Cotta Park at the location indicated on plan 2/4, dated December 4th, 2001, as prepared by the Horticultural division of the Recreation department of the former City of Pointe-Claire so that these keepers and owners may let their dog walk or run on these premises without having them on leash, the whole as per the provisions of the present by-law.
Said plan is attached herewith as schedule 1 and is identified under the signature of the secretary of the Pointe-Claire borough, dated February 12, 2002.
2. This dog run shall be open to the public daily from 7:00 a.m. until 10:00 p.m.
It shall be forbidden to access the dog run between 10:00 p.m. and 7:00 a.m.
3. When using the Terra Cotta Park dog run, the keeper or owner of a dog:
1° Must constantly keep an eye on his animal.
2° Master his animal whenever it becomes necessary to do so in order to comply with the provisions of this by-law.
3° Must not leave the premises without his animal.
4° Close the barrier after coming in or out the dog run.
4. In the Terra Cotta Park dog run, it shall be prohibited to:
1° Throw cigarette butts or any other type of waste on the ground.
2° Drink alcoholic beverages.
3° Play any game or sport with a ball or any other object than those which are used to safely play with a dog.
4° Drive a bicycle or any other vehicle.
5. The keeper or the owner of a dog must prevent his animal from digging holes or causing any other damages in the Terra Cotta Park dog run.
As the case may be, he must backfill any hole dug by his dog.
6. The keeper or the owner of a dog using the Terra Cotta Park dog run must remove therefore any defecation from his dog and place same within any of the garbage containers installed for this purpose.
7. The keeper or the owner of a dog acting aggressively with people or any other dog must immediately put his dog on leash and leave the premises.
8. The keeper or the owner of dogs is forbidden from bringing more than two (2) dogs at the same time in the Terra Cotta Park dog run.
9. It shall be prohibited for any person of less than 14 years old to bring a dog in the Terra Cotta Park dog run without being accompanied by another person of full age.
10. Access to the Terra Cotta Park dog run shall be permitted only for dogs wearing a dog tag issued by any competent authority of the Ville de Montreal. Such dogs must be three (3) months old or older.
11. Access to the Terra Cotta Park dog run shall be prohibited for:
1° Any sick dog.
2° Any dog not having been inoculated against rabies.
3° Any dog behaving aggressively towards any people or any other dog.
4° Any female dog in heat.
5° Any puppy aged less than three (3) months old.
6° Any stray dog.
12. The members of the Public Security division of the borough office of the borough of Pointe-Claire, as well as the members of the Police department of the Ville de Montréal shall be authorized to catch any stray dog found in the Terra Cotta Park dog run.
These persons shall be authorized to bring said dog to a pound and to have it kept for three(3) whole days during the course of which its owner may regain possession of his dog upon payment of the amount required for each day of detention of said dog.
Should the dog not be claimed within three (3) days of its impounding, said dog may be destroyed by euthanasia.
13. The Ville de Montréal may enter into an agreement with any person or body to authorize such person or body to enforce the whole or part of the provisions of the present by-law.
14. Whoever shall contravene any provision of the present by-law or suffer or permit any such contravention shall be guilty of an infraction and liable to a fine of:
1° No less than $50 and no more than $300 and the costs for a first offence, or;
2° In the case of a second or subsequent conviction, no less than $100 and no more than $600 and the costs.
15. The present by-law shall come into force in accordance with the law.
