RM 2228 - concerning the sale of adult literature


Article 1- For the purposes of this by-law, the following words and expressions mean:

 

1.1 Establishment: a building or part of a building in which goods or services are offered for sale to the public;

 

1.2 Adult literature: any book, magazine, newspaper or other publication appealing to or designed to appeal to sexual or erotic appetites by featuring breasts, in the case of a person of the feminine sex, or genitalia or buttocks, in the case of a person of either sex;

 

1.3 Minor: any person not having attained the full age of eighteen (18) years.

 

Article 2- In any establishment, adult literature must, at all times:

 

2.1 Be placed at least five (5) feet above the floor, and

 

2.2 Be concealed behind an opaque barrier so that no more than the top four (4) inches of the document is visible.

 

Article 3- It is prohibited for the person in charge of an establishment to permit or tolerate the reading or manipulation of adult literature by a minor.

 

Article 4- Anyone contravening a provision of this by-law is liable to a fine, the amount of which may not exceed three hundred dollars ($300.00) and which is set by the competent court, plus the costs determined by the tariff then in force. In default of payment of the fine and costs, the court may order the imprisonment of the offender for a period not exceeding two (2) months; however, such imprisonment shall cease upon payment of the fine and costs. If the infraction continues, such continuation shall constitute a separate offence, day by day.

 

Article 5- The present by-law abrogates by-law number 2209.

 

Article 6- The present by-law shall come into force according to law.
